Agreement to Terms
These Website Terms of Service (“Terms”) govern your access to and use of the website operated by Brush Neuropsychology Services, PLLC (“BNS,” “we,” “our,” or “us”), located at brushneuropsych.com and any related webpages, online forms, links, or features controlled by BNS (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, you should not access or use the Site.
These Terms apply only to use of the Site. They do not replace or modify any clinical consent forms, financial agreements, HIPAA forms, telehealth consents, releases of information, Good Faith Estimate documents, or other agreements that may apply if you become a client of BNS.
Healthcare Website Disclaimer
The information on this Site is provided for general informational and educational purposes only. It is not medical advice, psychological advice, neuropsychological advice, therapy, diagnosis, treatment, crisis intervention, or a substitute for consultation with a qualified healthcare professional.
Use of this Site does not create a clinician-patient relationship, psychologist-client relationship, therapist-client relationship, or professional relationship with BNS or any BNS clinician. A clinician-patient relationship is formed only after BNS agrees to provide services and all required intake, consent, financial, and clinical documentation has been completed.
Nothing on this Site should be relied upon as a diagnosis, treatment recommendation, forensic opinion, educational determination, disability determination, legal conclusion, or emergency guidance.
No Emergency or Crisis Services Through the Website
The Site is not intended for emergencies, urgent clinical needs, or crisis communication.
Do not use the Site, contact forms, email, voicemail, text messaging, or online scheduling requests for emergencies. If you are experiencing a medical, psychiatric, or safety emergency, call 911, go to the nearest emergency room, or contact an appropriate crisis resource.
BNS does not guarantee that messages submitted through the Site will be reviewed immediately.
Scope of Services
BNS provides neuropsychological evaluation, therapy, consultation, and related professional services as appropriate and within the scope of applicable law, licensure, training, and professional standards.
Information on the Site describing services, conditions, evaluations, therapy, testing, recommendations, or treatment approaches is general in nature. Actual services depend on clinical judgment, appropriateness of fit, informed consent, availability, applicable law, and the needs of the client.
BNS reserves the right to decline, discontinue, or refer out any inquiry or requested service when clinically, ethically, legally, or administratively appropriate.
Geographic and Licensure Limitations
BNS is located in Michigan and provides services consistent with applicable licensure laws and professional regulations. Availability of services may depend on the client’s physical location at the time services are provided, the clinician’s licensure status, applicable telehealth laws, and whether services are clinically appropriate.
Information on the Site should not be interpreted as an offer to provide services in any jurisdiction where BNS or its clinicians are not authorized to practice.
Website Contact Forms and Communications
The Site may allow you to submit contact forms, appointment requests, or general inquiries. These tools are intended for basic administrative communication only.
Please do not submit detailed clinical information, medical records, psychological history, school records, legal documents, crisis information, or other highly sensitive information through general website forms unless specifically instructed to do so through a secure method.
Submitting information through the Site does not guarantee that BNS will accept you as a client, provide services, schedule an appointment, or respond within any particular timeframe.
Email, website forms, text messaging, and other electronic communications may not be fully secure and may carry some risk of unauthorized access. By using non-secure communication methods, you acknowledge and accept these risks. Information collected through the Site is also addressed in our Website Privacy Policy and, when applicable, our HIPAA Notice of Privacy Practices.
HIPAA and Privacy
BNS maintains separate privacy policies and clinical privacy notices. Information submitted through the Site may be governed by our Website Privacy Policy. Information created, received, maintained, or transmitted by BNS in connection with clinical services may be protected health information under HIPAA and governed by our HIPAA Notice of Privacy Practices.
HHS has issued guidance explaining that HIPAA-regulated entities must be careful when using online tracking technologies that may collect or disclose individually identifiable health information. BNS seeks to configure website technologies and online tools in a manner consistent with applicable privacy and security obligations..
Michigan also recognizes privacy protections for mental and behavioral health information, and state resources note that consent may be required for certain disclosures of mental health records beyond treatment, payment, and care coordination.
Online Scheduling, Portals, Payments, and Third-Party Platforms
The Site may link to or integrate with third-party services, such as patient portals, electronic health record systems, online scheduling platforms, payment processors, map services, website hosting services, or other external tools.
Those third-party services may have their own terms of use, privacy policies, security practices, and data practices. BNS is not responsible for the content, security, availability, or privacy practices of third-party websites or platforms that BNS does not control.
Use of a patient portal, telehealth platform, payment processor, or electronic health record system may be subject to additional terms, consents, and privacy notices.
Permitted Use of the Site
You may use the Site only for lawful, personal, non-commercial purposes, including learning about BNS, reviewing general service information, and contacting BNS about potential services.
You agree not to use the Site in any way that violates applicable law, infringes the rights of others, interferes with the Site’s operation, or compromises the security, integrity, or availability of the Site.
Prohibited Activities

- Use the Site for unlawful, fraudulent, abusive, harassing, or harmful purposes;

Intellectual Property
All content on the Site, including text, graphics, logos, images, design elements, videos, downloadable materials, forms, service descriptions, page layouts, and other materials, is owned by BNS or used with permission and is protected by copyright, trademark, and other intellectual property laws.
You may view and print limited portions of the Site for personal, non-commercial use only. You may not copy, reproduce, distribute, modify, display, publish, sell, license, or create derivative works from Site content without prior written permission from BNS.
The name Brush Neuropsychology Services, PLLC, related logos, branding, taglines, and other identifying materials may not be used without written permission.
Educational Materials and Downloadable Content
The Site may include articles, FAQs, educational materials, forms, checklists, handouts, or downloadable resources. These materials are provided for general informational purposes only and may not apply to your specific circumstances.
Use of these materials does not create a clinician-patient relationship and should not be relied upon as individualized medical, psychological, neuropsychological, educational, legal, or financial advice.
Testimonials, Reviews, and External Listings
The Site may include links to external directories, search engines, professional profiles, or review platforms. BNS does not control third-party review platforms or external listings.
Any testimonials, reviews, or comments appearing on external platforms reflect the views of the individuals who posted them and may not represent typical results or experiences. BNS does not guarantee any particular clinical, educational, legal, disability, employment, or treatment outcome.
No Guarantees
BNS does not guarantee that use of the Site or receipt of services will result in any particular diagnosis, recommendation, school accommodation, disability determination, legal outcome, employment outcome, treatment result, or improvement in symptoms or functioning.
Clinical outcomes vary based on individual circumstances, available information, participation, clinical complexity, and many other factors.
Disclaimer of Warranties
The Site and all content, features, materials, and links are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, BNS disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, availability, merchantability, fitness for a particular purpose, title, and non-infringement.
BNS does not warrant that the Site will be uninterrupted, secure, error-free, virus-free, or available at all times, or that any defects will be corrected.
Limitation of Liability
To the fullest extent permitted by applicable law, BNS and its owners, members, clinicians, employees, contractors, representatives, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to your access to, use of, or inability to use the Site. Nothing in these Terms is intended to disclaim liability that cannot lawfully be disclaimed under applicable law, including liability arising from professional obligations applicable to licensed healthcare providers.
This includes, without limitation, damages for loss of data, loss of goodwill, business interruption, emotional distress, reliance on website content, unauthorized access, website errors, third-party links, or delays in communication.
Nothing in these Terms is intended to limit liability in a way that is prohibited by applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless BNS and its owners, members, clinicians, employees, contractors, representatives, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use or misuse of the Site;
- Your violation of these Terms;
- Your violation of applicable law;
- Your submission of false, misleading, unlawful, or harmful information;
- Your infringement of any intellectual property, privacy, or other rights of another person or entity; or
- Your interference with the security or operation of the Site.
Availability and Site Changes
BNS may update, modify, suspend, discontinue, or restrict access to all or part of the Site at any time without notice. BNS is not responsible if any portion of the Site is unavailable at any time.
BNS may update service descriptions, fees, availability, policies, and other information on the Site. Website content may not always reflect the most current practice policies, clinical procedures, fee schedules, or legal requirements.
Fees and Payment Information
The Site may include general information about service fees, payment policies, private-pay status, superbills, deposits, cancellation fees, or related financial matters. Any website fee information is for general informational purposes and may be subject to change.
Actual fees, payment obligations, deposits, cancellation policies, and billing terms are governed by BNS’s current financial policies, Good Faith Estimate documents when applicable, and signed client agreements.
No Insurance or Reimbursement Guarantee
If BNS provides information about superbills, out-of-network benefits, private-pay services, or possible reimbursement, that information is general and does not guarantee insurance coverage, reimbursement, medical necessity determinations, or payment by any insurer or third-party payor.
Clients are responsible for understanding their own insurance benefits and financial obligations unless otherwise stated in a signed agreement.
User-Submitted Information
If you submit information through the Site, you represent that the information is accurate to the best of your knowledge and that you have authority to submit it.
For minors, dependent adults, or individuals represented by a parent, guardian, personal representative, or authorized representative, the person submitting information represents that they have appropriate authority to do so.
BNS may decline to act on submitted information until identity, authority, consent, or documentation is verified.

The Site may contain links to third-party websites, resources, articles, organizations, directories, portals, maps, social media pages, or services. These links are provided for convenience only.

Governing Law and Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.
To the extent permitted by law, any dispute arising out of or related to these Terms or use of the Site shall be brought in the state or federal courts located in Oakland County, Michigan, unless another venue is required by applicable law.
Severability

No Waiver
BNS’s failure to enforce any provision of these Terms does not waive BNS’s right to enforce that provision or any other provision in the future.
Entire Agreement Regarding Website Use
These Terms, together with the Website Privacy Policy, constitute the entire agreement between you and BNS regarding use of the Site.
These Terms do not replace or supersede any separate clinical, financial, privacy, telehealth, informed consent, release of information, or other agreement between you and BNS.
